The Legal Practice Board was requested by Accountability Now (AN), a non-profit organization, to remove the name of the Public Protector (PP), Busisiwe Mkhwebane, from the advocates.
It follows the Constitutional Court’s ruling that she had acted and lied under oath. Adv Paul Hoffman, a director at AN, said in a letter to the Legal Practice Council that the findings against the PP are serious and final and that her honesty, integrity and competency as PP is affected.
Dr Pieter Groenewald, leader of the FF Plus says that the ruling and findings of the Constitutional Court this morning against the Public Protector (PP), Adv. Busisiwe Mkhwebane, who has, among other things, exceeded her mandate, is damning and in fact she says she is incompetent for office as South Africa’s EM.
The Constitutional Court found this morning that the Public Prosecutor’s Office had issued a “large amount of untruths” in the case and her report was not based on sound economic advice. Also, she failed to explain why she had not met the president and the state security agency when her investigation was underway.
The case stems from a report by Mkhwebane in June 2017 in which she ordered Absa to repay R1,125 billion to the Reserve Bank. According to the OB, it was a “rescue buoy” that the Reserve Bank unlawfully paid to Bankorp in the apartheid years.
The court found that the OB had violated its mandate, she was not honest and did not meet with the parties mentioned in the report.
It raises a lot of questions about her latest findings regarding President Cyril Ramaphosa and once again creates the impression that she is not impartial and objective as expected.
The FF Plus once again calls for the investigation into Mkhwebane’s competence and competence to be speeded up at Parliament’s portfolio committee on justice, especially after today’s ruling by the Constitutional Court.
Should the PP be suspended and / or if there are pending investigations against her, it will jeopardize the cases at which she is currently involved.
